1. Scope of application 

The general terms and conditions (hereafter referred to as “GTC”) apply to all offers made by Parvati Experiences GmbH (hereafter referred to as “Parvati”). Parvati reserves the right to change the GTC. The version valid at the time of booking shall apply. For reasons of readability, the masculine form has been chosen in the text, nevertheless the information refers to members of both genders. 

2. Registration / Conclusion of contract

Registration can be made in writing, by e-mail or by telephone. By booking, the participant accepts the terms and conditions as part of the contract between him/her and Parvati. The registration will be confirmed by e-mail and becomes binding.

3. Conditions of participation

Good health and appropriate equipment are required for all offers. The physical condition required for the booked tour increases the enjoyment and experience for all participants. If a participant does not meet the physical requirements despite a corresponding note on the offer, he/she can be excluded from the tour without any right to a refund.

4. Payment

An invoice will be sent with the confirmation of registration. For day and weekend tours, the amount is to be paid at the latest 10 days before the tour. In the case of short-term registrations, the amount is to be transferred immediately.

For offers lasting three days or more, a deposit of 20% must be paid within 14 days of receipt of the confirmation of registration. The balance is due 30 days before the start of the offer. In the case of registrations at short notice, the total price must be paid immediately.

If the payment is not received on time, Parvati can cancel the contract and claim the cancellation costs according to the section “Cancellation by the participant”.

5. Cancellation by Parvati

If Parvati has to cancel an offer for the following reasons, any payments already made will be refunded. Any deposits made to hotels, flights and agencies which Parvati does not receive back will be deducted from this refund. Further claims are excluded.

5.1 Cancellation before the start of the activity

Should weather and natural conditions, official measures, force majeure, security or other reasons make the offer considerably more difficult, dangerous or impossible, Parvati can cancel the offer or change the area. Participants will be informed immediately of any cancellations.

5.2 Changes and cancellation en route

Should weather and natural conditions, official measures, force majeure, security or other reasons make the activity considerably more difficult, dangerous or impossible, Parvati can, with mutual agreement with the participants, change or even cancel the offer. Any resulting additional costs for travel and/or accommodation will be borne by the participants. In the event of a cancellation, there is no entitlement to a refund.

6. Withdrawal by the participant

Should a participant not be able to take part in the planned offer for any reason, Parvati must be informed as soon as possible, if possible in writing by e-mail.

If the participant withdraws from the contract or breaks off the tour on the way, he/she has to pay a lump sum for expenses of CHF 50.00 for a one-day tour. For offers lasting two or more days, this flat rate is CHF 80.00.

In addition, the following costs will be charged:

  • Cancellation 30 -14 days before the start: 50 % of the offer price.
  • Cancellation less than 14 days before the start: 100 % of the offer price.

In addition, there will be any costs for accommodation already booked and services provided by third parties, which will not be reimbursed to Parvati.

Participants are advised to take out cancellation insurance.

7. Insurance

Insurance is the responsibility of the participant. Parvati recommends that all participants have adequate liability, accident and health insurance, including sufficient cover for rescue and transport costs. As mentioned above, Parvati also recommends that participants take out cancellation insurance.

8. Liability

Parvati offers the greatest possible security. However, there remain natural risks and dangers that cannot be avoided or excluded despite careful planning and guidance. By registering, the participant acknowledges these dangers and risks and waives any claims for damages and/or liability in this respect. This also applies to theft, loss or damage of own or rented material.

9. Visual material

Parvati reserves the right to use film and picture material taken during the offer for print products, website and picture galleries. Persons may be recognisable on the photographic material. Guests agree to this without any right to compensation.

10. Data protection

Parvati uses customer data for the processing of registrations and for sending its own offers by post or e-mail.

11. Applicable law and jurisdiction

Swiss courts have exclusive jurisdiction for all disputes, regardless of the amount in dispute, nationality and place of execution. These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law. The place of jurisdiction is Brig-Glis, Canton Valais.
